1. Grant of Rights

By purchasing or downloading a photo or video, you, the customer, are granted a limited, non-exclusive, non-transferable license to use the purchased digital images and footage for personal, non-commercial use only. This includes the right to:

• Share the photos and videos with friends and family.

• Post the photos and videos on personal social media accounts (e.g., Facebook, Instagram, YouTube) as long as the use is non-commercial.

• Print copies of the photos for personal display.

• Create personal-use products like photo albums or mugs.

2. Restrictions on Use

You may not use the photos or video footage for any commercial purpose without explicit written permission from Ken Mark Photography. Prohibited commercial uses include, but are not limited to:

• Using the photos or videos to promote a business, product, or service.

• Selling the photos or videos to a third party.

• Using the photos or videos for advertising or marketing campaigns.

• Submitting the photos or videos to contests or publications without prior approval.

• Editing or altering the video footage beyond basic trimming and compiling for personal use.

3. Copyright

All photos and video footage, and the copyright therein, remain the exclusive property of Ken Mark Photography. This license does not transfer or assign any copyright ownership to you.

4. Model Release

You acknowledge that by purchasing or downloading the photos or videos, you are not receiving a model release. You are responsible for ensuring you have the necessary permissions from any recognizable individuals in the media for any use beyond personal, non-commercial purposes. As the photographer/videographer, Ken Mark Photography has obtained a general media release from the league or event organizer, but this does not grant you the right to use the media for commercial purposes.

5. Photographer’s Use of Images and Footage

By purchasing a photo or video, you grant Ken Mark Photography an irrevocable, perpetual, royalty-free license to use, display, and publish any image or footage we create for our own marketing and portfolio purposes. This includes, but is not limited to:

• Displaying the media on our website and social media channels (e.g., Instagram, Facebook, YouTube).

• Using the media in promotional materials, such as advertisements or brochures.

• Including the media in our online and physical portfolios.

If you wish to have a photo or video removed from our public display for a specific reason (e.g., privacy concerns), please contact us directly at info@kenmarkphotography. While we cannot guarantee immediate removal, we will review your request and make a decision at our sole discretion.

6. Limitation of Liability

Ken Mark Photography is not responsible for any legal issues that may arise from your unauthorized or improper use of the photos or videos. You agree to indemnify and hold harmless Ken Mark Photography from any claims, damages, or liabilities arising from your breach of these terms.

7. Digital Download

All sales of digital downloads are final. Due to the nature of digital products, refunds or exchanges are not available once the download is complete.
